TRAFFIC INFRACTIONS

Class A traffic infractions in Colorado are traffic violations punishable by $15 to $100, a surcharge, and DMV points. Since they are civil and not criminal, class A traffic infractions carry no jail time. But failure to pay the ticket will trigger a driver’s license suspension. And class A traffic infractions can never be sealed from the person’s record.

Class B traffic infractions in Colorado are minor traffic violations that are punishable by $15 to $100 plus a small surcharge and no DMV points. As civil cases, class B traffic infractions carry no jail time. But failure to pay can result in a driver’s license revocation. And class B traffic infractions cannot be sealed from the person’s record.

TRAFFIC MISDEMEANORS

Class 1 misdemeanor traffic offenses in Colorado are punishable by:

  • 10 days to 12 months in county jail,
  • $300 to $1,000 in fines, as well as
  • DMV Points

Convictions can never be sealed from the defendant’s criminal record. But it may be possible to get the charges reduced to a class 2 misdemeanor traffic offense or a traffic infraction or dismissed completely.

Class 2 misdemeanor traffic offenses in Colorado are punishable by:

  • 10 to 90 days in county jail and/or
  • $150 to $300 in fines, plus
  • DMV points

Traffic misdemeanor convictions can never be sealed from criminal records. But prosecutors may be willing to reduce the charge down to a traffic infraction or even grant a dismissal.

DRIVER’S LICENSE POINTS

Point Suspensions

Your license will be suspended if you accumulate too many points from traffic tickets. In Colorado, you start off with 0 points and when convictions are reported to the DMV, you have points added to your record. A summary of the points bracket by age follows:

Minor Driver 17 & Under

Points Requiring Suspension

  • 6 or more within any 12 months
  • 7 or more at any point while under 18 

Minor Driver 18 – 21

Points Requiring Suspension

  • 9 or more within any 12 months
  • 12 or more within any 24 months
  • 14 or more at any point between ages 18-21

Adult 21 & Over

Points Requiring Suspension

  • 12 or more within any 12 months
  • 18 or more within any 24 months
